1. Introduction

These Terms and Conditions ("Terms") govern all quotations, orders, and sales made by Abbott Mellor Ltd through our website, telephone, email, and fax. By accessing our services and placing an order, you agree to abide by these Terms. Please read them carefully before making a purchase.

2. Quotations

  • Validity: Any quotation provided by Abbott Mellor Ltd is valid for four weeks from the date of issuance. After this period, we reserve the right to revise the quotation based on current pricing and other relevant factors.
  • Specifications: When requesting a quotation, please provide detailed illustrations or descriptions if the goods are not in standard sizes or specifications. Any special requirements, standards, or alterations must be communicated in writing. Quotations based on estimated information or site plans may be subject to adjustment once accurate site measurements are obtained.
  • Changes: Quotations given over the phone, email, or fax, which are based on estimated data, are subject to change upon verification of the site details.

3. Pricing

  • Price Adjustments: Abbott Mellor Ltd reserves the right to adjust prices before delivery. Price changes may be due to factors beyond our control, including increases in labor costs, material costs, changes in foreign exchange rates, currency regulations, import duties, or alterations in delivery methods.
  • Notice: We will notify you of any significant price changes prior to the delivery of goods.

4. Delivery

  • Charges: All prices are exclusive of delivery charges. The cost of delivery will be added to your invoice and must be paid by the buyer.
  • Delays: While we strive to meet delivery times, Abbott Mellor Ltd is not liable for delays caused by factors such as traffic, accidents, incorrect delivery addresses, or carrier issues. We will inform you as soon as possible if there are any anticipated delays.
  • Inspection: The buyer is advised to inspect all goods before signing the delivery note. Abbott Mellor Ltd is not responsible for any damages or shortages reported after delivery has been completed.
  • Unloading: Due to the size and weight of the goods, the buyer is responsible for unloading the goods at the delivery site. Ensure that the delivery site has adequate space and facilities for unloading.

5. Returns

  • Incorrect Goods: If incorrect goods are delivered due to an error on the part of the customer (e.g., wrong product ordered), and the goods need to be returned while still on the truck, the customer will be liable for the delivery cost and a 20% restocking charge. Additionally, if the goods have been removed from their packaging, the customer will be responsible for any re-powder coating charges incurred to restore the goods to their original condition.
  • Custom Orders: Returns are not accepted for custom-made or bespoke orders. This includes items that are tailored to specific customer requirements, such as custom gates or posts.

6. VAT

  • Tax: All prices quoted are exclusive of Value Added Tax (VAT). VAT will be added to the total invoice amount at the standard prevailing rate and is the responsibility of the buyer.

7. Dimensions/Data/Technical Information

  • Alterations: Abbott Mellor Ltd reserves the right to alter dimensions and specifications within reasonable limits. All weights and dimensions quoted are subject to normal commercial tolerance.
  • Illustrations: Drawings, pictures, and other illustrative information provided are for general guidance only and are not part of any contract. Variations in sizes and shapes may occur due to different suppliers or changes in manufacturing processes.
  • Tolerances: Our products are manufactured to meet standard tolerances in dimensions and specifications.

8. Payment

  • Invoicing: The company is entitled to invoice the buyer for the goods upon delivery or when the goods are ready for collection. Payment is required in full before collection or delivery unless a written credit agreement is in place.
  • Terms: Payment must be made immediately unless otherwise agreed. For orders placed without a written credit agreement, payment must be completed before delivery or collection. Payment terms for credit accounts are 30 days from the date of the invoice.
  • Late Payment: In the event of late payment, interest may accrue on the unpaid amount at a rate of 4% per annum above the Bank of England base rate. A part of a month will be treated as a full month for interest calculations.
  • Credit Card Fees: A 2.5% charge applies to payments made by credit card, with a maximum limit of £500.00 for phone transactions.

9. Customer Drawings

  • Responsibility: It is the customer’s responsibility to provide accurate and suitable drawings and information. Any special requirements, specifications, or standards must be communicated in writing.
  • Product Descriptions: Customers are strongly advised to review product descriptions carefully before placing an order. If further information is needed, please contact us for clarification.

10. Guarantee and Defects

  • Inspection: We strongly recommend that customers check all quantities and conditions of goods before arranging installation. Any defects identified at the time of delivery or within three days should be reported in writing and the goods should not be used.
  • Warranty: All products come with a standard twelve-month warranty covering defects in material and workmanship. Products not manufactured by Abbott Mellor Ltd are covered under the warranty provided by the respective manufacturer.
  • Exclusions: The warranty does not cover defects arising from normal wear and tear, misuse, negligence, or unauthorized alterations or repairs. Claims for defects not reported within 24 hours of delivery and confirmed within three business days may be invalid.
  • Remedies: For valid warranty claims, Abbott Mellor Ltd may choose to replace the defective item or refund the purchase price. We are not liable for any further damages, additional costs, or losses incurred.

11. Storage

  • Free Storage: We offer free storage of goods for up to one week from the date you notify us that the goods are ready for collection.
  • Extended Storage: If the collection or delivery is delayed by the buyer, we can store the goods for up to three months. After this period, we reserve the right to sell or dispose of the goods at our discretion.

12. Liability

  • Limitations: Abbott Mellor Ltd is not liable for any incidental or consequential damages unless caused by our negligence or under the Consumer Protection Act 1987. Our liability is limited to the cost of the goods.
  • Performance: We are not liable for delays or failures in performance due to factors beyond our control, including but not limited to natural disasters, strikes, or other external events.

13. Changes to Terms

Abbott Mellor Ltd reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them periodically.
